I Slipped and Fell at a Store—Can I Sue?

If you were injured in a slip and fall at a store, restaurant, supermarket, or other business in Ohio, you may have a personal injury claim against the business. The question is not whether you fell, but whether the business's negligence caused the fall. What You Must Prove

In Ohio, property owners owe a duty of care to customers (invitees). You generally need to show: (1) a dangerous condition existed (wet floor, tripping hazard, uneven surface, poor lighting, debris), (2) the owner knew or should have known about the hazard (through reasonable inspection or complaints), (3) they failed to fix it or warn you adequately, and (4) the condition directly caused your injury and damages. The owner may argue the hazard was "open and obvious"—meaning you should have seen it and avoided it. An attorney can counter that by showing the hazard was in an unexpected location, you were distracted by something the store did, or the condition was not truly obvious given the lighting, crowds, or other circumstances.

What to Do Right Away

Report the incident to the manager and request an incident report. Take photos of the exact spot where you fell and the hazard (before it is cleaned up). Take photos of your injuries. Get contact information from any witnesses. Seek medical attention within 24–48 hours, even if you feel fine. Keep all medical records and receipts.

Statute of Limitations

You have two years from the date of the fall to file a lawsuit in Ohio. Do not wait—evidence and witnesses can disappear, and the longer you wait, the harder it is to prove what caused your fall.
